By using [www.memofy.shop] (the “Store”) or placing an order, you agree to these Terms of Service.

Acceptance of terms

Before placing an order, customers have access to these Terms of Service, the Return and Refund Policy, Shipping Policy, Privacy Policy, product description, product price, and applicable delivery information.

By submitting an order and completing payment, the customer confirms that they have reviewed and agree to these policies and to the product information shown on the relevant product page.

The customer is responsible for reviewing the product description, selected quantity, order details, shipping address, and contact information before submitting an order.

Nothing in these Terms removes or limits rights that cannot legally be excluded under applicable consumer-protection law.

Products and orders

We make reasonable efforts to ensure that product descriptions, prices, photographs, and availability information are accurate.

Minor variations in items, colors, packaging, design, or appearance may occur due to screen settings, production batches, or ordinary product variation. Minor variations that do not materially affect the product’s intended use or substantially differ from its description are not considered defects.

All products are subject to availability. We may correct errors in pricing, product information, or availability before processing an order. If an error materially affects a paid order, we may cancel the affected order and issue a refund.

An order confirmation means that we have received the order; it does not guarantee acceptance or availability of the product.

We may refuse, cancel, or limit an order when reasonably necessary, including where a product is unavailable, there is a pricing or listing error, payment cannot be authorized, the order appears fraudulent or abusive, or the customer provides materially inaccurate order or delivery information.

If we cancel a paid order, we will issue a refund for the unfulfilled item(s) to the original payment method where possible.

Prices are shown in USD unless otherwise stated. Customers are responsible for applicable taxes, import duties, customs charges, currency-conversion fees, and other destination-country charges unless the Store expressly states otherwise.

Fraudulent orders and payment disputes

We take reasonable measures to protect the Store and customers from unauthorized transactions, fraudulent orders, and abuse of refund or payment-dispute processes.

We may refuse, cancel, or limit an order where there are reasonable grounds to believe it involves fraudulent, unauthorized, deceptive, or abusive activity.

If there is a problem with an order, customers should contact us first at memofy.shop@gmail.com so that we can review the matter and attempt to resolve it.

Customers retain all legal rights to dispute transactions with their payment provider. However, knowingly false, duplicate, or bad-faith payment disputes are prohibited. Where a payment dispute is opened, we may provide the payment provider with relevant order records, including order confirmation, communications, product details, delivery information, and evidence of any resolution offered.

Intellectual property

All Store content, including product names, text, graphics, photographs, designs, logos, branding, and other materials, is owned by or licensed to Memofy.

You may not copy, reproduce, publish, distribute, resell, or commercially use any Store content without our prior written permission.

Limitation of liability

To the maximum extent permitted by law, Memofy is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising from use of the Store or a purchase from the Store.

To the maximum extent permitted by law, our total liability for a claim relating to an order will not exceed the amount actually paid for the product or products giving rise to that claim.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded, including mandatory consumer rights, fraud, or intentional misconduct.

Governing law and disputes

These Terms are governed by the laws of State of Florida, United States, without regard to conflict-of-law rules, except where mandatory consumer-protection law in the customer’s place of residence applies.

Before initiating a legal claim, the customer agrees to contact us at memofy.shop@gmail.com and allow at least 30 days for a good-faith attempt to resolve the issue.

This provision does not prevent either party from seeking urgent legal relief or exercising rights that cannot legally be waived.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Store with a revised effective date.

The version of these Terms in effect when an order was placed will generally apply to that order, except where a change is required by law or provides greater protection to the customer.
